Offer vs. Bargain — What's the Difference?

An offer is the initial step in the formation of a contract, where one party expresses their willingness to enter into an agreement with another party, often specifying the terms under which they are willing to make a deal. This can involve the sale of goods, provision of services, or other transactions. On the other hand, a bargain is the result of negotiation between parties, where each party concedes something in order to reach a mutually beneficial agreement. A bargain often follows an offer and involves a more interactive exchange of terms until both parties are satisfied.

Offers can be seen as a unilateral communication that may or may not require a response from the other party. It is essentially a proposal that can be accepted or rejected. Bargains, however, are inherently bilateral, arising out of discussions and negotiations where both parties actively participate. Conversely, a bargain reflects the final terms agreed upon after negotiation, embodying the principle of reciprocity and mutual benefit, which is at the heart of the bargaining process. This mutual agreement is what differentiates a bargain from a mere acceptance of an offer.
